The Internet has changed the paradigm by which many technology companies do business. These changes can be most profoundly seen in development and licensing of software. 'Open source' software refers to software that is made available to licensees in both object code and source code form. Oftentimes, the software is made available under an 'open source license' that requires licensees to redistribute software under that same license, ensuring that downstream recipients receive the software with the same rights that upstream distributors enjoy. While considered a somewhat unorthodox approach as compared to other industries, this method of development and distribution is fairly common amongst computer programmers who enjoy the ability to collaborate freely with other coders.

On the legal side, open source presents a whole host of challenges which include licensing rights, indemnification issues, sharing issues. Who owns the code? Who is responsible if the end product damages the user's computer? How is revenue shared? These are all thorny issues that attorneys and general counsel at technology firms must grapple with when trying to create agreements for open source products and services. To Claim Your CLE Credits:

The attorney should simply include credits earned via Knowledge Group webcasts when computing the total number of CLE credits completed, and keep the Knowledge Group Certificate of Attendance for a period of at least four (4) years in case of audit. An attorney may count towards her/his New York CLE requirement credit earned through the Approved Jurisdiction policy without notifying the CLE Board.
