David C. Shonka has been the Principal Deputy General Counsel of the Federal Trade Commission since 2008 and he heads the FTC’s E-Discovery Steering Committee. Until recently he has served as the agency’s Acting General Counsel. Before becoming the Principal Deputy, he served as the Assistant General Counsel for Litigation at the FTC from 1993. Before joining the FTC, Mr Shonka was an associate in a Washington D.C. law firm and a litigator in the Civil Division of the United States Department of Justice. In his career at the FTC, Mr. Shonka has tried and argued competition and consumer protection cases in the federal district courts; tried cases in administrative proceedings, represented the Commission in numerous appellate cases; and contributed to the government’s briefs in several Supreme Court cases. He has spoken at numerous E-Discovery conferences, and has been an instructor in deposition, trial, and motion practice courses. Besides having been an active litigator, Mr. Shonka has advised the Commission on the entire range of legal and policy issues that have come before the Commission; and he has represented the Commission in several International Technical Assistance Programs.

Fred is a member of KPMG LLP’s Forensic Advisory Services practice and leads its national Records Risk Management service line. He has been a Partner with KPMG for 26 years. In his 36 years of experience with KPMG, Fred served as an Audit Partner in the New York City Banking Practice from 1985 to 1988, and led the Chicago Financial Services Audit Practice through 1998, when he joined the St. Louis Advisory Services Practice.

Fred’s industry experience includes banking, broker dealer and investment advisors, as well as consumer products. Core strengths and accomplishments include: Instituted an enterprise wide Records Management Program and Governance Structure for a major U.S. broker dealer by leading a KPMG team; Conducted a needs assessment and built definition requirements for a Records Management application at a major professional services organization; Lead KPMG’s Response/Support to assist an international bank and a U.S. broker leader in responding to FDIC/NASD regulatory actions relating to Records Management failures; Assisted KPMG internal audit teams in conducting audit assessments of Record Management Programs at two national financial service organizations; Developed business requirements for the selection and implementation of an Enterprise Records Management solution for a Fortune 50 Company.

David J. Lender

David Lender is a partner and commercial litigator in the New York office of Weil, Gotshal & Manges LLP. Over the past several years, he has successfully tried numerous cases to verdict, including a complete defense jury verdict for ESPN in a $231 million lawsuit brought by Modi Entertainment Network and a $416.88 million plaintiff jury verdict for ExxonMobil against Saudi Basic Industries Corporation (SABIC).
Mr. Lender is a nationally recognized expert in electronic discovery. He is the co-author of a book on the subject entitled Electronic Discovery: Law and Practice (Aspen Publishing, 2009 Suppl.), which has been cited in numerous landmark electronic discovery cases by federal courts; author of the book Privilege Issues In The Age of Electronic Discovery (BNA, 2008); and is a frequent lecturer and author on the subject. He is also the head of his firm’s E-discovery Task Force.
Mr. Lender is a member of the Advisory Board for the Georgetown Law Center E-Discovery Institute, and a member of the editorial board for The Federal Lawyer. He received his J.D. degree with High Honors, Order of the Coif, from the Duke University School of Law in 1993, and his B.A. degree, cum laude, from Duke University in 1990.
Amy Longo

Amy Jane Longo is a partner in the Securities Litigation Practice and co-chair of the Electronic Discovery and Document Retention Practice. Amy represents corporations, their directors and officers in securities class actions, derivative suits, ERISA class actions, and a range of general commercial litigation, as well as internal investigations and enforcement matters. In addition, Amy counsels public and private companies on their document retention policies and best practices for electronic discovery and litigation response plans. Amy was recognized by the Daily Journal for her work representing Quiksilver, Inc. in a three-week jury trial in the United States District Court in the Central District of California, in which the jury found for Quiksilver, on claims for trademark infringement and false designation of origin and the Court thereafter entered a permanent injunction requiring the defendant to phase out all use of its competing trademark.
Amy is a leader in the American Bar Association, serving as co-chair of the Section of Litigation’s Class Actions and Derivative Suits Committee and co-chair of the 2010 ABA Annual Meeting. She is listed as a “Southern California Super Lawyers Rising Star” for her securities litigation work (2005-2008). Amy also writes and lectures frequently at a national level.
